마닐라 – 타귁시 정부는 월요일 729헥타르의 보니파시오 글로벌 시티 단지와 여러 다른 마을이 이웃 마카티가 아닌 도시의 일부라는 대법원(SC)의 최종 판결을 환영했습니다.

월요일 성명에서 시는 판결을 "타귁과 그 사람들을 위한 새로운 장"의 시작이라고 불렀습니다.

“어떤 면에서 Taguig만이 이 법적 경쟁에서 유일한 승자가 아닙니다. 더 큰 의미에서 양 당사자가 법체계를 신뢰하는 가운데 법의 지배가 우세하다”고 말했다.

“우리는 새로운 프로그램과 프로젝트를 도입하여 유권자를 위해 운영하는 서비스를 확장하고 개선하기 위해 더욱 열심히 노력할 것입니다. 시 정부는 "우리는 변혁적이고 활기차고 배려하는 도시를 만들 수 있는 자원을 갖고 있다"고 말했다.

두 페이지 분량의 결의안에서 SC의 특수 제3사단은 마카티 시 정부가 제출한 12월 1일 판결 취소를 요구하는 재검토 요청을 거부했습니다. 2021년 1월 1일 결정은 Taguig City에 유리했습니다.

“2021년 12월 1일 공포된 증명서에 대한 재심 청원을 기각한 결정에 대한 청원인의 옴니버스 재심의 신청에 따라, 법원은 제기된 기본 쟁점에 대해 위 결정에서 법원”이라고 결의문을 읽었습니다.

SC는 2021년 결정에서도 8월 1일 발부된 가처분 영장을 영구화했다. 1994년 2월 2일 Pasig City 지방 재판 법원은 Makati City 정부가 "관할권 행사, 개선 또는 영토의 일부로 취급하는 것"을 금지하는 Parcels 3 및 4, Psu 2031, Fort Bonifacio 포함 - Barangays Pembo, Comembo, Cembo, South Cembo, West Rembo, East Rembo 및 Pitogo로 구성된 Inner Fort라고합니다.

필리핀 육군 본부, 해군 기지, 해병대 본부, 영사관 지역, 미군 합동 자문단 지역, 헤리티지 공원, 리빙간 임가 바야니, 필리핀 국군 장교 마을 및 7개 마을이 해당 지역에 위치하고 있습니다.

“추가된 역사적 증거, 제출된 지적 측량, 합법적인 당국의 동시대 행위를 고려할 때 Taguig가 Makati가 제시한 것보다 더 설득력 있고 믿을 만한 증거를 제시했음을 알 수 있습니다. 결과적으로 우리는 Taguig가 분쟁 지역에 대해 우월한 주장을 가지고 있다고 판결합니다.”라고 SC는 Makati City가 제출한 청원을 거부하면서 말했습니다. (PNA)

[4.3] Final SC ruling on BGC row start of Taguig’s ‘new chapter’

MANILA – The Taguig City government on Monday welcomed the final ruling of the Supreme Court (SC) that the 729-hectare Bonifacio Global City complex and several other villages is actually part of the city, not of its neighbor Makati.

In a statement Monday, the city called the ruling the start of “a new chapter for Taguig and its people.”

“In a way Taguig is not the only victor in this legal contest. In a bigger sense, with both parties putting their trust in the legal system, it is the rule of law which prevailed,” it said.

“We will work even harder to expand and improve the services we run for our constituents, by introducing new programs and projects. We have the resources to bring about a transformative, lively, and caring city,” the city government said.

In a two-page resolution, the SC’s Special Third Division has denied the motion for reconsideration filed by the Makati City government, seeking the reversal of a Dec. 1, 2021 decision favoring Taguig City.

“Acting on petitioner’s omnibus motion for reconsideration of the decision promulgated on December 1, 2021, which denied the petition for review on certiorari, the Court resolves to deny the motion with finality, the basic issues therein raised having been duly considered and passed upon by the Court in the aforesaid decision,” the resolution read.

The SC, in its 2021 decision, also made permanent the writ of preliminary injunction issued on Aug. 2, 1994 by the Regional Trial Court of Pasig City enjoining the Makati City government “from exercising jurisdiction over, making improvements on, or otherwise treating as part of its territory” Parcels 3 and 4, Psu 2031, comprising Fort Bonifacio, including the so-called Inner Fort, comprised of Barangays Pembo, Comembo, Cembo, South Cembo, West Rembo, East Rembo and Pitogo.

The Philippine Army headquarters, Navy installation, Marines’ headquarters, Consular area, Joint US Military Advisory Group area, Heritage Park, Libingan ng mga Bayani, Armed Forces of the Philippines Officers Village, and seven villages are situated in the said areas.

“Considering the historical evidence adduced, cadastral surveys submitted, and the contemporaneous acts of lawful authorities, we find that Taguig presented evidence that is more convincing and worthier of belief than proffered by Makati. Consequently, we rule that Taguig has a superior claim to the disputed areas,” the SC said in denying the petition filed by Makati City. (PNA)
